These Terms of Service ("Terms") govern your use of Instify, a macOS application ("the App") operated by the Instify team ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Instify. By using the App, you confirm that you meet this requirement.

2. License

We grant you a personal, non-exclusive, non-transferable license to use Instify on your own macOS device(s). Each license is per individual user. You may not reverse-engineer, decompile, redistribute, sublicense, or resell the App or any part of it.

3. Subscriptions and billing

Instify offers a free tier and two paid subscription plans — Standard and Pro — billed monthly. Paid subscriptions are processed through Polar.sh, our payment provider. By subscribing, you also agree to Polar's Terms of Service.

You may cancel your subscription at any time from your Polar.sh account. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not issue refunds for partial billing periods unless required by applicable law.

4. AI agents and third-party services

Instify integrates with third-party AI services including Anthropic Claude Code and OpenAI Codex. Your use of those agents is also governed by their respective terms of service:

We are not responsible for the output, accuracy, or behavior of AI-generated code. You are solely responsible for reviewing and using any code produced by AI agents within the App.

5. Your content

Your projects, user stories, and code remain entirely on your local machine. We do not upload, access, or store your project contents. You retain full ownership of everything you create with Instify.

6. Acceptable use

You agree not to use Instify to:

Generate or distribute malware, spyware, or any malicious software
Violate any applicable laws or third-party rights
Circumvent or attempt to circumvent subscription restrictions

7. Disclaimer of warranties

Instify is provided "as is" without warranty of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or produce any particular result. Use at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or any AI-generated output, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the new Terms.

10. Governing law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of competent jurisdiction.
